Terms of Service

1. Acceptance of Terms

By accessing, browsing, or utilizing the Apptimate One Construction ERP platform, you agree to comply with and be bound by these standard Terms of Service. If you do not agree to these terms, you must cease use of the system immediately.

2. Platform Licensing & Usage

Apptimus Tech grants the client a non-transferable, non-exclusive, terminable license to use the Apptimate One system solely for internal business processes, subject to user license counts and active subscription tiers. Reverse-engineering or re-distributing core platform binaries is strictly prohibited.

3. Proposal & Pricing Validity

Standard product proposals and pricing quotes remain valid for 60 days from issuance. Scope amendments or delays in project initiation may result in a review of delivery timelines and associated licensing costs.

4. Intellectual Property Rights

All custom integration pipelines, client dashboard structures, and site-specific reports become the intellectual property of the client upon full payment of milestone fees. Apptimus Tech retains full, absolute ownership of the core system architecture, databases schemas, pre-trained AI weights, and proprietary engines.

5. Confidentiality & Mutual NDA

Both parties agree to treat all business plans, project drawings, financial quotes, and system architecture data as proprietary information. Strict data isolation is enforced, and no telemetry or client operational records are ever shared with external parties.

6. SLA, Support & Maintenance

System uptime is guaranteed at 99.9% under standard hosting configurations. Priority support, database backups, security patches, and AMC maintenance plans are governed by the signed service level agreement and corresponding schedule attachments.

7. Warranty & Liability Limits

A 6-month product warranty is provided post-go-live, covering system performance issues and bug corrections. Apptimus Tech is not liable for indirect, consequential, or incidental operational losses arising from delayed vendor integrations.
